Website Services Agreement

Between Sree Gadde, doing business as Sitework, a registered Texas DBA ("Sitework", "we", "us") and the client named on the order form ("Client", "you") · Effective on the date you accept it during checkout

1. What this agreement covers

This agreement covers the design, build, and launch of a website for your business, plus any add-on services and any monthly management plan you select on the order form at thesitework.com/order.html (the "Order"). The Order is part of this agreement.

5. Logo

If you upload a logo, we use it as provided. If you order logo design ($100), we design a logo and you approve it before it is used. If you have no logo and do not order one, we create a clean monogram from your company name at no charge.

6. Domain

If you have a domain, you keep ownership of it, whether you manage it or we manage it for you. If we purchase a domain for you, it is registered for your business, billed to you at registrar cost with no markup, and it is yours.

7. Managed plan, or self managed

If you choose the managed plan ($50 per month): we host the site, keep it secure and backed up, and make reasonable content updates when you ask (text, photos, hours, services). Requests can be submitted at thesitework.com/support, or by call or text, and are usually completed within a few business days. The monthly fee starts at launch and is billed by subscription. You can cancel anytime with 30 days notice, and we will hand you the complete site files and point you to hosting options when you go.

If you choose self managed: at launch, after final payment, we deliver the complete website files and account access. From that point hosting, updates, and upkeep are your responsibility. We are glad to help later at rates we agree on then.

8. Ownership

When your balance is paid in full, the website, its design, and its content belong to you. Until then, the work belongs to Sitework. We may show your finished website in our portfolio and marketing, and you may ask us not to at any time.

9. What we do not promise

We build websites that are designed to win you customers, and no one can honestly guarantee search rankings, call volume, or revenue. We do not promise specific business results. We also are not responsible for third party services we do not control, such as your domain registrar, Google, or your phone carrier.

10. If either of us walks away

You may cancel the project at any time before approving your website, in writing, and you owe nothing: your invoice is voided. Once you approve the website, the full amount is due even if you later choose not to launch it. We may cancel the project if we cannot complete the work, and if we cancel you owe nothing.

11. Liability

To the fullest extent allowed by law, Sitework's total liability under this agreement is limited to the amount you actually paid us. We are not liable for indirect damages such as lost profits or lost business.

13. Electronic acceptance

Checking the agreement box on the order form and typing your full name counts as your electronic signature, with the same effect as signing on paper, under the federal ESIGN Act and the Texas Uniform Electronic Transactions Act.
